What is Probate?
Probate is the process where the High Court of New Zealand confirms that a Will is valid and gives the executors the legal authority to deal with the deceased person's property and assets.
If an estate includes land or has assets worth more than **$15,000** at any one financial institution (like a bank), probate is legally required.

Many families pay too much for probate by letting a law firm handle the entire estate administration. You can often save thousands by hiring a lawyer *only* for the probate application and doing the administration (closing accounts, etc.) yourself.

Once submitted to the High Court, it typically takes **4 to 8 weeks** for probate to be granted, depending on the court's current backlog.
What if there is no Will?
If there is no Will, you must apply for **Letters of Administration**. This process is similar to probate but slightly more complex and usually more expensive.
When do I pay the fees?
Legal fees for probate are usually paid **from the estate assets** once they are released. Most lawyers will not require payment upfront, though the High Court filing fee may be required.
